1. Agreement to Terms

By accessing or using DrawSortAI ("Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part, you may not use the Service.

These Terms constitute a legally binding agreement between you and DrawSortAI.

2. Description of Service

DrawSortAI is an AI-powered construction drawing classification service that:

• Accepts ZIP archives containing PDF construction drawings
• Automatically classifies drawings into categories (floor plans, elevations, sections, etc.)
• Provides organized, downloadable results
• Offers manual review and correction capabilities
• Continuously improves through machine learning

3. User Accounts

3.1 Account Creation

• You must be at least 18 years old to create an account
• You must provide accurate, complete information
• You are responsible for maintaining account security
• You must not share your account credentials
• One account per person/organization

3.2 Account Security

• Choose a strong, unique password
• Notify us immediately of any unauthorized access
• You are responsible for all activities under your account
• We may suspend accounts showing suspicious activity

3.3 Account Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these Terms, with or without notice.

4. Subscription Plans

4.1 Free Tier

• Upload limit: 100MB per file
• All core classification features included
• Manual review and corrections available
• Files deleted after 7 days
• Rate limited to 10 uploads per hour

4.2 One-Off Jobs (£10 Ex VAT per job)

• No subscription required
• Process up to 500MB per job
• Results available for 48 hours
• Same accuracy as Pro tier
• Price excludes UK VAT (currently 20%)

4.3 Pro Tier - Early Adopter Pricing (£25/month Ex VAT)

• Available to user sign-ups 1-25 only
• Grandfathered forever - your rate is locked in permanently
• No file size limits
• Priority processing
• Extended file retention (30 days)
• Higher upload rate limits (50 per hour)
• Email support
• Batch processing API access
• Price excludes UK VAT (currently 20%)

4.4 Pro Tier - Standard Pricing (£49/month Ex VAT)

• Available to user sign-ups 26-100 only
• Grandfathered forever - your rate is locked in permanently
• All features from Early Adopter tier
• No file size limits
• Priority processing
• Extended file retention (30 days)
• Higher upload rate limits (50 per hour)
• Email support
• Batch processing API access
• Price excludes UK VAT (currently 20%)

4.5 Pro Tier - Current Pricing (£79/month Ex VAT)

• Available to user sign-ups from 101 onwards
• Grandfathered forever - your rate is locked in permanently
• All features from previous Pro tiers
• No file size limits
• Priority processing
• Extended file retention (30 days)
• Higher upload rate limits (50 per hour)
• Email support
• Batch processing API access
• Price excludes UK VAT (currently 20%)

4.6 Billing

• All prices shown exclude UK VAT (currently 20%)
• Pro subscriptions billed monthly via Stripe in GBP
• Automatic renewal unless cancelled
• Cancel anytime - no refunds for partial months
• Failed payments result in account downgrade to Free tier
• VAT charged according to UK tax regulations
• EU customers may be subject to reverse charge mechanism

5. Acceptable Use Policy

5.1 You MAY:

• ✅ Upload construction drawings in PDF format
• ✅ Use the Service for commercial projects
• ✅ Download and use your sorted drawings
• ✅ Provide feedback and corrections
• ✅ Share results with your team/clients

5.2 You MAY NOT:

• ❌ Upload files containing malware, viruses, or malicious code
• ❌ Upload non-construction-related content
• ❌ Attempt to reverse-engineer our AI model
• ❌ Scrape, crawl, or automate access beyond API limits
• ❌ Share your account credentials
• ❌ Circumvent rate limits or security measures
• ❌ Upload illegal, offensive, or copyrighted content you don't own
• ❌ Resell or redistribute the Service
• ❌ Use the Service to train competing AI models

6. Intellectual Property Rights

6.1 Your Content

• You retain all ownership of drawings you upload
• You grant us a temporary license to process and classify your drawings
• We may use anonymized text data to improve our AI model
• We never claim ownership of your drawings
• We don't share your drawings with third parties

6.2 Our Service

• DrawSortAI, our logo, design, and AI model are our intellectual property
• You may not copy, modify, or reverse-engineer our Service
• Our classification algorithm is proprietary and protected

7. Service Accuracy and Limitations

7.1 Accuracy Expectations

• Our AI model provides automated suggestions, not guaranteed classifications
• Typical accuracy: 85-95% depending on drawing quality and complexity
• Always review results before using in production
• Low-confidence files are flagged for manual review
• We continuously improve accuracy through user feedback

7.2 Limitations

• Service depends on legible text within drawings
• Scanned drawings may have lower accuracy
• Non-English drawings may not classify accurately
• Highly specialized or custom drawing types may be misclassified
• Processing times vary based on file size and server load

7.3 No Professional Advice

DrawSortAI is a tool, not a substitute for professional judgment. We do not provide:

• ❌ Architectural or engineering advice
• ❌ Construction management services
• ❌ Compliance or regulatory guidance
• ❌ Professional certification of accuracy

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

8.1 We Are Not Liable For:

• Classification errors or inaccuracies
• Delays in construction projects due to sorting errors
• Financial losses from misclassified drawings
• Data loss due to technical failures
• Service downtime or unavailability
• Third-party service failures (Wasabi, Stripe, Render)
• Loss of business, revenue, or profits

8.2 Maximum Liability

Our total liability to you for any claims is limited to the amount you paid us in the 12 months before the claim, or £100 (GBP), whichever is less.

8.3 Your Responsibility

You are responsible for:

• Verifying all classification results
• Backing up your drawings before uploading
• Ensuring drawings are suitable for automated processing
• Using the Service in compliance with applicable laws

9. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including:

• Merchantability or fitness for a particular purpose
• Uninterrupted or error-free operation
• Accuracy, reliability, or completeness
• Freedom from bugs, viruses, or harmful components

Some jurisdictions don't allow warranty disclaimers, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless DrawSortAI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your uploaded content

11. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key points:

• Files deleted within 1 hour of processing
• Results available for 7 days (Free) or 30 days (Pro)
• All data encrypted in transit and at rest
• GDPR and UK GDPR compliant
• You can request data deletion at any time

12. Cancellation and Refunds

12.1 Cancellation

• Cancel Pro subscription anytime from your dashboard
• Access continues until end of billing period
• No charges after cancellation
• Reactivate anytime

12.2 Refund Policy

• Pro subscriptions: No refunds for partial months
• One-off jobs: Refund if processing fails (within 48 hours)
• Exceptions: Technical failures preventing service use

12.3 We May Terminate

We reserve the right to suspend or terminate accounts that:

• Violate these Terms
• Engage in abusive or fraudulent behavior
• Cause technical or security issues
• Remain inactive for over 2 years (with 30 days notice)

13. Service Modifications

We may:

• Modify, suspend, or discontinue the Service at any time
• Change pricing with 30 days notice
• Update features or capabilities
• Perform maintenance that temporarily disrupts service

We'll provide reasonable notice for significant changes.

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of England and Wales.

14.2 Informal Resolution

Before filing any legal claim, contact us at legal@drawsortai.com to resolve the dispute informally.

14.3 Jurisdiction

Any legal disputes will be resolved in the courts of England and Wales.

15. General Terms

15.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and DrawSortAI.

15.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

15.3 No Waiver

Our failure to enforce any right doesn't constitute a waiver of that right.

15.4 Assignment

You may not transfer your rights under these Terms. We may assign our rights to any affiliate or successor.

15.5 Updates to Terms

We may update these Terms occasionally. Continued use after changes constitutes acceptance. We'll notify you of material changes via email.
